TERMS AND CONDITIONS OF SALE (CGV) AND TERMS AND CONDITIONS OF USE (CGU) OF THE NEOVALYS REAL ESTATE PLATFORM

PREAMBLE

These Terms and Conditions of Sale (CGV) and Terms and Conditions of Use (CGU) govern the use of the NeoValys Real Estate platform, accessible at the following address: www.neovalys.com, operated by NeoValys Real Estate Lda. . (hereinafter “NeoValys”), a company registered in Portugal under registration number 517443783 with its registered office located at Rua 7 De Novembro, Nr. 7 1º Esqº 2835-163 - BAIXA DA BANHEIRA, Portugal.

By accessing and using the NeoValys Real Estate platform, users (hereinafter Users or Clients) expressly agree to comply with these terms.

I. DEFINITIONS

  • Platform: The website www.neovalys.com, as well as any mobile application or other online means of access that allows consultation of rental and sale offers of real estate offered by NeoValys Real Estate.
  • User: Any individual or legal entity accessing the platform to consult or use its services, whether a private individual or a professional.
  • Services: The services offered by NeoValys Real Estate, namely, the facilitation of rental or sale of third-party real estate.
  • Advertiser: The property owners, real estate agencies, or any other third party using the platform to post rental or sale offers.

II. TERMS AND CONDITIONS OF USE (CGU)

  • Purpose and scope of the CGU These terms govern access to the platform and the use of its services. By using the platform, the User agrees to fully comply with the conditions set forth herein.
  • Access to the platform Access to the platform is free, unless the User opts for paid services (advertising of listings, premium services, etc.). The User guarantees the accuracy of the information provided during registration and agrees not to disclose their login credentials to third parties.
  • Use of the platform The User agrees to use the platform in compliance with applicable laws and regulations, as well as with the rights of other users. Any fraudulent, illegal, or unethical use will result in the immediate suspension of the User's access to the platform.
  • Intellectual Property The platform, its content (texts, images, logos, software, etc.), and the services offered are protected by intellectual property rights. Any reproduction, distribution, modification, or use without prior authorization is prohibited.
  • Personal Data Protection NeoValys commits to respecting the confidentiality of Users' personal data. This data is collected and processed in accordance with the privacy policy available on the platform.
  • Liability NeoValys is not responsible for the information contained in listings published by third parties (advertisers). In case of a dispute between a User and an advertiser, NeoValys will not intervene and recommends that the dispute be resolved directly between the parties.
  • Modification of CGU NeoValys reserves the right to modify these terms at any time. The modifications will be published on the platform and will take effect as soon as they are published.
  • Termination and Suspension NeoValys reserves the right to suspend or terminate access to the platform for any User who does not comply with the terms of use or violates applicable laws.

III. TERMS AND CONDITIONS OF SALE (CGV)

  • Purpose of the CGV These terms govern sales made on the NeoValys Real Estate platform, whether for rental or sale of properties offered by advertisers.
  • Purchase or Rental Procedure The User can consult the listings offered by advertisers, contact them through the platform, and enter into a rental or sales agreement directly with the advertiser. NeoValys does not participate in negotiations or the finalization of contracts between the parties.
  • Price and Payment The prices of properties are set by the advertisers. NeoValys may charge additional fees for certain services, such as promoting listings or premium services. Payments are made directly between the User and the advertiser, unless a specific payment service is offered via the platform.
  • Guarantee and Liability NeoValys commits to providing a functional platform and ensuring the proper presentation of listings. However, NeoValys is not liable for defects, errors, or omissions in listings published by advertisers. The User should verify the information before making any decisions.
  • Service Fees Depending on the services chosen by the advertisers or users (advertising, premium services, etc.), service fees may apply. These fees are clearly indicated before the transaction is confirmed.
  • Modification or Cancellation of Listings Advertisers can modify or cancel their listings at any time via the platform, within the limits established by NeoValys. In case of cancellation or modification of a listing after a transaction is completed, NeoValys will not be held responsible.
  • Dispute Resolution In case of a dispute between the User and the advertiser, NeoValys will not intervene in the resolution of the conflict. However, NeoValys will make efforts to facilitate communication between the parties. In case of litigation, users may resort to a mediator or seek the competent jurisdiction.
